Education Technology Companies
An education technology (edtech) company offers learning content, platforms, tutoring or related services to students, schools and universities through digital means. Some edtech companies sell directly to learners and parents. Others work with institutions through licences, partnerships or managed programmes.
An edtech company deals with several bodies of law at once: the Companies Act, 2013 and the laws on startups and investment; the Digital Personal Data Protection Act, 2023, including verifiable parental consent and the bar on tracking or targeted advertising directed at children; the Information Technology Act, 2000; consumer protection and e commerce law on refunds and advertising; and copyright and trademark law for content and brand.
A company that works with universities must also look at the regulations of the UGC and the AICTE on online and distance programmes, and at UGC public notices on arrangements between universities and edtech companies. These notices have changed over time and must be checked before any agreement is signed.
